Types of Criminal Sexual Contact in Michigan

As a general term, criminal sexual contact is any form of unwanted sexual contact that is obtained using force, intimidation, or coercion without consent. Sexual contact is defined as the act of intentionally touching another person’s genitals, breasts, inner thigh, buttocks, anus, or clothing covering those intimate parts for sexual pleasure. CSC charges are divided into four different degrees that encompass a wide range of illegal sexual conduct, with penalties ranging in severity depending on the nature of the offense.

  • First degree: Sexual acts involving penetration that involve a victim under 13 years old, a victim of blood relation, a victim that is incapacitated or otherwise unable to consent, or personal injury and force can be charged as first degree felony CSC. Penalties for a first degree CSC conviction can include life imprisonment and lifetime registration as a sex offender.
  • Second degree: Sexual conduct involving any of the circumstances listed for first degree CSC without penetration are charged as felony second degree CSC, carrying up to 15 years in prison and mandatory registration as a sex offender.
  • Third degree: Sexual conduct involving penetration against a victim age 13 to 15, against any victim using force or coercion, or against an incapacitated victim may be charged as felony third degree CSC. A conviction of third degree CSC can carry up to fifteen years in prison and sex offender registration.
  • Fourth degree: Fourth degree CSC is a misdemeanor offense carrying up to two years in prison and fines up to $500. Any criminal sexual contact involving force, coercion, or committed against a victim who is unable to consent can be charged as fourth degree CSC.
